1. Acceptance of Terms

By accessing and using Design Your Assay ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Design Your Assay is a web-based platform that provides tools and services for designing PCR primers for molecular biology research. The service includes primer design algorithms, sequence analysis tools, and related bioinformatics capabilities.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept all risks of unauthorized access to your account

4. Acceptable Use

You agree not to use the Service to:

  • Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
  • Violate any applicable local, state, national, or international law
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service
  • Use the Service for any commercial purpose without our express written consent

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Design Your Assay and its licensors. The Service is protected by copyright, trademark, and other laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our express written permission.

6. User Content

You retain ownership of any content you submit to the Service. However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content in connection with the Service. You represent that you have all necessary rights to grant this license.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection and use of your information.

8. Disclaimers

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. The results provided by our primer design tools are for research purposes only and should be validated before use in critical applications.

9. Limitation of Liability

In no event shall Design Your Assay be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

10. Subscription and Payment Terms

For paid subscriptions:

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We reserve the right to change our pricing with 30 days' notice
  • Failure to pay fees may result in suspension or termination of your account

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Massachusetts, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Massachusetts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
